Independent Contractor Relationship
These Affiliate Program Terms govern a contractor relationship between you (the affiliate) and Orwellix. They are separate from our general Terms and Conditions, which govern user accounts and subscriptions. Participation in the affiliate program does not create an employment, partnership, or agency relationship.
Who can apply and how the approval process works.
1. Eligibility Requirements
To be eligible for the Orwellix Affiliate Program, you must:
- Be at least 18 years of age.
- Have an active digital presence, a blog, YouTube channel, newsletter, podcast, or social media account, through which you promote content to a real audience.
- Hold a valid PayPal account registered to your name or business, as all payouts are processed via PayPal.
- Not be a current Orwellix employee, contractor, or immediate family member of one.
- Agree to comply with all applicable laws governing advertising, endorsements, and affiliate marketing in your jurisdiction (including FTC disclosure requirements where applicable).
Orwellix reserves the right to approve or reject any application at its sole discretion, without obligation to provide a reason.
2. Application & Approval
- How to Apply: Submit your application at orwellix.com/affiliate-program. You will be asked to describe your promotional channels and strategy.
- Review Period: Applications are reviewed within 24–48 hours of submission.
- Notification: You will receive an automated email confirming approval or rejection.
- Referral Link: Upon approval, you receive a unique referral link in the format
https://orwellix.com?ref=yourcode. This link is non-transferable and must not be shared with or used by any other person or entity. - Re-application: Rejected applicants may re-apply after 30 days if their circumstances have changed, by contacting to our affiliate team at [email protected], not through the application form.
How commissions are calculated, when they are held, and how and when payouts are processed.
3. Commission Structure
Approved affiliates earn a 20% commission on all qualifying subscriptions referred through their unique link.
3.1 Monthly Plans (Recurring)
- Commission is paid on every successful renewal, for up to 12 consecutive months per referred subscriber.
- Pro Plan ($24/mo): $4.80 per renewal.
- Premium Plan ($39/mo): $7.80 per renewal.
- Maximum per subscriber across 12 renewals: $93.60.
3.2 Yearly Plans (One-Time)
- Commission is a single payment equal to 20% of the full annual price paid at checkout.
- Pro Yearly ($238/yr): $47.60.
- Premium Yearly ($418/yr): $83.60.
Rate Changes: Orwellix may adjust commission rates with at least 30 days' written notice. Commissions already in your payable balance at the time of a rate change are not affected.
4. Attribution & Cookie Window
- Cookie Duration: 15 days from the date of the referred visitor's initial click on your link.
- Scope: Attribution applies only on the same device and browser in which the cookie was set. Clearing cookies, switching devices, or switching browsers resets attribution.
- Last-Click: If a visitor clicks multiple affiliate links, credit is given to the most recent click within the active window.
- Self-Referrals Prohibited: You may not sign up for an Orwellix subscription through your own referral link. Self-referral commissions will be reversed and may result in account suspension.
5. Commission Hold Period
Commissions are created as soon as a referred user signs up and starts their free trial, but pass through two sequential hold stages before moving to your payable balance:
- Stage 1 - Free Trial Hold (7 days): A commission is created immediately when the referred user begins their free trial, with a status of pending and a hold phase of free trial. It remains in this phase for the 7-day trial duration.
- Stage 2 - Refund Window Hold (10 days): Once the referred user upgrades to a paid plan, the commission moves to the refund period hold phase. It remains here for 10 days to cover Orwellix's money-back guarantee window.
- Total Hold: Up to 17 days from the date the referred user starts their free trial. After both stages clear, the commission becomes valid and moves to your payable balance.
- Reversals: If a referred subscription is refunded, cancelled during the hold window, or subject to a chargeback, the associated commission is reversed and will not be paid.
6. Payouts
- Schedule: Payouts are processed on the 1st–5th of each month for balances that meet the minimum threshold.
- Method: All payouts are made via PayPal to the email address registered in your affiliate account.
- Minimum Threshold: $50.00 USD. Balances below this amount roll over to the following month with no expiry.
- Currency: All commissions and payouts are denominated in USD.
- Incorrect Details: Orwellix is not responsible for failed or delayed payouts resulting from an incorrect or inactive PayPal email address provided by the affiliate. It is your responsibility to keep your payout details current in the affiliate portal.
- Forfeiture: Unclaimed or undeliverable payouts may be forfeited after 12 months of inactivity if no valid PayPal address can be confirmed.
7. Taxes
Affiliates are independent contractors. You are solely responsible for reporting and paying all applicable taxes on commissions earned through this program, including income tax, self-employment tax, VAT, or any other levies imposed by your jurisdiction. Orwellix will provide documentation required by law (e.g., 1099 forms for U.S.-based affiliates meeting applicable thresholds). Orwellix will not withhold taxes on behalf of affiliates unless legally required to do so.
What you may and may not do when promoting Orwellix.
8. Permitted Promotional Methods
You may promote Orwellix through:
- Blog posts, articles, and written reviews on your own website.
- YouTube videos, podcasts, and other original media content.
- Email newsletters sent to your own opted-in subscriber list.
- Organic social media posts on your own accounts.
- Display advertising on your own digital properties.
- Honest comparisons and reviews, including comparisons with competing products, provided all claims are accurate and not misleading.
9. Prohibited Conduct
Violations Will Result in Suspension
Engaging in any of the following will result in immediate account suspension, forfeiture of pending commissions, and potential permanent termination from the program.
- Self-referrals: Signing up for an Orwellix subscription through your own referral link, or arranging for associates to do so on your behalf.
- Spam: Sending unsolicited email, bulk messaging, or posting referral links in unrelated forums, comment sections, or communities.
- Cookie Stuffing: Any technique that sets the affiliate cookie on a user's browser without a genuine, deliberate click from that user.
- Misleading Claims: Making false or exaggerated statements about Orwellix's features, pricing, or results.
- Trademark Bidding: Bidding on the keyword "Orwellix" (or misspellings) in paid search advertising without prior written approval from Orwellix.
- Domain Misuse: Registering domain names containing "Orwellix" or any confusingly similar variation.
- Incentivized Clicks: Offering rewards, cash-back, or discounts in exchange for using your referral link, unless explicitly approved in writing by Orwellix.
- Unauthorized Coupon Sites: Listing your referral link on coupon aggregator or deal sites without prior written approval.
10. Account Suspension & Termination
- By Orwellix: Orwellix may suspend or terminate your affiliate account at any time, with or without cause, upon 7 days' written notice, except in cases of fraud or prohibited conduct, where termination is immediate.
- By You: You may terminate your participation at any time by emailing [email protected]. Commissions already in your payable balance above the minimum threshold will be paid in the next payout cycle.
- Effect of Termination: Upon termination, your referral link is deactivated immediately. Commissions earned before the termination date and not yet in hold status remain payable; commissions in hold at the time of termination for cause may be forfeited.
11. Affiliate Portal
Approved affiliates receive access to a dedicated portal at /affiliate/dashboard containing their referral link, performance statistics, commission history, and payout records. Orwellix may modify, expand, or restrict portal features at any time without prior notice.
12. Program Modifications
Orwellix reserves the right to modify any aspect of the Affiliate Program including commission rates, payout schedules, cookie window duration, and these terms, at any time. Material changes will be communicated by email to your registered affiliate address with at least 30 days' notice. Continued participation in the program after a change takes effect constitutes your acceptance of the updated terms. If you do not accept a change, you must terminate your participation before the effective date.
13. Intellectual Property & Brand Use
Orwellix grants you a limited, revocable, non-exclusive license to use the Orwellix name and approved logos solely for the purpose of promoting the affiliate program through permitted channels. You must use only officially approved brand assets, which are available in the affiliate portal. This license is revoked automatically upon termination of your affiliate account.
14. Limitation of Liability
To the maximum extent permitted by law, Orwellix shall not be liable for any indirect, incidental, special, or consequential damages arising from your participation in the Affiliate Program, including lost commissions resulting from technical failures, program changes, or account suspension. Orwellix's total liability to you under these terms shall not exceed the total commissions paid to you in the three months immediately preceding the event giving rise to the claim.
15. Governing Law & Contact
These Affiliate Program Terms are governed by the laws of the jurisdiction in which Orwellix is established, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation before any formal proceedings.
